By accessing or using our mobile gaming services and related functionalities ("Service") provided by FlareHeat Limited, a corporation registered at 80 Atlantic Ave, Suite 400, Toronto ON, M6K 1X9, Canada ("FlareHeat", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). These Terms affect your legal rights and obligations. If you do not agree to be bound by all of these Terms, do not access or use the Service.

7. Content Restrictions

Is sexually explicit or pornographic, incites violence, or contains nudity or graphic or gratuitous violence.

Promotes any illegal activity, or advocates, promotes, or assists any unlawful act.

 

 

8. Your Use of the Service

 

You may not interfere with or disrupt the Service or servers or networks connected to the Service, including by transmitting any worms, viruses, spyware, malware, or any other code of a destructive or disruptive nature. You may not inject content or code or otherwise alter or interfere with the way any FlareHeat page is rendered or displayed in a user's browser or device.

9. Rights in the Service

All rights, title, and interest in and to the Service (excluding Content provided by users) are and will remain the exclusive property of FlareHeat and its licensors. Nothing in the Terms gives you a right to use the FlareHeat name or any of the FlareHeat trademarks, logos, domain names, and other distinctive brand features. Any feedback, comments, or suggestions you may provide regarding FlareHeat, or the Service is entirely voluntary and we will be free to use such feedback, comments or suggestions as we see fit and without any obligation to you.

 

10. Restrictions

You may not do any of the following while accessing or using the Service:

 

Access, tamper with, or use non-public areas of the Service, FlareHeat’s computer systems, or the technical delivery systems of FlareHeat’s providers.

Disable, interfere with, or try to circumvent any of the features of the platform related to security or probe, scan, or test the vulnerability of any of our systems.

Copy, modify, create a derivative work of, reverse engineer, reverse assemble, or otherwise attempt to discover any source code of or content on the FlareHeat platform.

Access or search or attempt to access or search our Service by any means (automated or otherwise) other than through our currently available search functionalities that are provided via our website, mobile apps, or API (and only pursuant to those API terms and conditions). You may not scrape, spider, use a robot, or use other automated means of any kind to access the Services.

11. Termination

FlareHeat may terminate or suspend your right to use our Service at any time for any or no reason by providing you with written or email notice of such termination, and termination will be effective immediately upon delivery of such notice. Without limitation of the foregoing, we may terminate or suspend your right to use our Service if you breach any provision of these Terms or any policy of FlareHeat, or if you use our Services in a manner that FlareHeat believes may cause it liability.

 

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

 

13. Changes to the Service

FlareHeat reserves the right at any time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that FlareHeat shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

 

14. General

Your agreement also includes any additional terms imposed by the platform through which you access the Service, including Apple App Store and Google Play Store terms.

 

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Disclaimer of Warranties

​

The Service is provided "as is" and "as available" without warranties of any kind. FlareHeat disclaims all warranties, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

16. Limitation of Liability

​

To the maximum extent permitted by law, FlareHeat shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenues, arising from your use of the Service.
